Sorry for coming in a little late on the legal obligations debate but I know that in some other countries e.g. Australia it has been advised by registration boards that sexual assault victims should not be administered hypnosis or emdr prior to statements being made or perpetrators being identified. It seems some clever attorney used the fact that EMDR had been administered to argue that it COULD have affected the person's memory and therefore evidence. Also, on the issue of the use of EMDR being resisted by some clients due to "invalidating" their experience, these people have to make a choice. DO they want to be an angry victim forever or "let go" of their anger?. Most want to keep a little bit which I guess is OK in the long run.
