    Recovered memories seem to be common. As a trial lawyer, I see recovered memory phenomena everyday in the ordinary course. Commonly called "witnesses preparation," it has all the aspects naturalistic trance as described by Erickson. Well "prepared" witnesses simply sell cases better to juries.

    If a therapist invites a patient to remember something, the therapist may be liable in tort. If a lawyer does the same thing, it's called advocacy. Consistent with Erickson's client-centered theories, the lawyer who understands the mental landscape of a witness is more likely to be effective in helping the witness prepare his or her testimony.
