The entire adjudication, grievance and civil suit process for Psychologists and Social Workers in the US should be done away with. The system is stacked entirely against client, the therapist holds all cards in the process, the boards are inept and incompetent at investigating and getting at the truth, the good therapists lose because they tell the truth, and the quacks get off the hook because they will lie to save their professional ass. The grievance process is not flawed. It is unworkable. It gives clients a false sense of security that the boards will protect clients from quacks, when in fact they do not. Throw the APA, the NASW and IFSW codes out the window, they are worth about a roll of toilet paper. Many state boards do not even use them to interpret ethical conduct anyway, so they are worthless in Administrative Law Proceedings, and in effect make believe fantasy land codes that are un enforced. Whey even upgrade or downgrade codes? Just throw them into the trash. All therapists follow their own individual modes of treatment and types of psychotherapy anyway. After the oversight system is done away with, a.) the client will know that she or he has no protection, and will be more cautious who she or he sees for therapy and b.) If a client does have a legitimate complaint like having a sexual relationship with therapist, they should just take it to criminal court and file rape charges. Then instead of losing a license that does not exist, the shrink just goes to jail for a decade or so, and after they get out of the slammer, they can start working again, because there will be no regs. as to whether or not convicted felons can themselves up in private practice. I agree with you, I don’t think life is fair. That is why the APA should throw the codes in the trash, so that if not fair, at least people can get some truth. And in my opinion, the truth is more important than what is fair and what is not.
