If you go back and read my post, I already acknowledged this point: if falls under the context of discovery. Shapiro's fated "walk in the park" falls under this rubric, as does the accidental poisening of workers at rubber factories that led to the identification of antabuse. However, we are past the context of discovery now. We are in the context of justification. And in the context of justification, it boils down to logic and data.
